2. Hosting and server log files
This website is hosted by Railway Corp., 548 Market St PMB 68956, San Francisco, CA 94104, USA. When the site is accessed, the host automatically stores server log files containing the IP address, the time of access, the page requested, the browser and the operating system. The purpose is the secure and trouble-free operation of the website; the legal basis is Art. 6(1)(f) GDPR, our legitimate interest in the security and functioning of the website. Railway processes the data as a processor (Art. 28 GDPR). Railway Corp. is certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR); the EU Standard Contractual Clauses apply in addition (Art. 46(2)(c) GDPR), see section 6. The log files are deleted after 7 days.
3. Contact form
If you use the form to enquire about a trial session, we process your name, email address, phone number and your optional message solely in order to handle the enquiry and arrange an appointment. The legal basis is Art. 6(1)(b) GDPR (pre-contractual measures at your request); where the enquiry is not directed at concluding a contract, Art. 6(1)(f) GDPR, our legitimate interest in answering enquiries.
The enquiry is sent by email to our mailbox kontakt@incharge-ems.de. For dispatch we use Resend, operated by Plus Five Five, Inc., 2261 Market Street #5039, San Francisco, CA 94114, USA, as a processor (Art. 28 GDPR); the message is stored there on servers in the USA and deleted after 30 days. Plus Five Five, Inc. is certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR); the EU Standard Contractual Clauses apply in addition (Art. 46(2)(c) GDPR), see section 6. The mailbox itself is operated at Google Workspace, see section 4.
Please do not submit health information via the form; we discuss that in person at the studio.
We delete your enquiry data as soon as the enquiry has been dealt with conclusively, and at the latest three months after the last contact. If a contract is concluded, we retain the contract-related documents for six and ten years respectively under § 147 AO and § 257 HGB.
4. Contact by email or telephone
If you contact us by email or by telephone, we process the details you provide in order to deal with your request, on the basis of Art. 6(1)(b) GDPR and otherwise Art. 6(1)(f) GDPR (legitimate interest in answering enquiries). Our email mailbox is operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (Google Workspace) as a processor (Art. 28 GDPR). This may involve a transfer to Google LLC in the USA. Google LLC is certified under the EU-U.S. Data Privacy Framework (Art. 45 GDPR); the EU Standard Contractual Clauses apply in addition (Art. 46(2)(c) GDPR), see section 6. The retention period is as set out in section 3.
5. Cookies
This website sets no cookies and stores no information on your device.
6. Transfers to the USA
The service providers named in sections 2 to 4 are certified under the EU-U.S. Data Privacy Framework (adequacy decision of the European Commission, Art. 45 GDPR; list at https://www.dataprivacyframework.gov/list). In addition, we have agreed the EU Standard Contractual Clauses with them (Art. 46(2)(c) GDPR). You may request a copy at kontakt@incharge-ems.de.
7. Your rights
You have the right of access (Art. 15 GDPR), to rectification (Art. 16), to erasure (Art. 17), to restriction of processing (Art. 18) and to data portability (Art. 20). An informal message to kontakt@incharge-ems.de is sufficient.
Right to object (Art. 21 GDPR): You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data based on Art. 6(1)(f) GDPR. We will then no longer process the data unless we can demonstrate compelling legitimate grounds which override your interests, rights and freedoms, or the processing serves to establish, exercise or defend legal claims.
You also have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR); for us this is: Berliner Beauftragte für Datenschutz und Informationsfreiheit, Alt-Moabit 59–61, 10555 Berlin, mailbox@datenschutz-berlin.de.
8. Provision of data
You are neither legally nor contractually obliged to provide us with personal data. Without your name, email address and phone number, however, we cannot process an enquiry submitted through the form.
